Terms of Service

These pages are written for a solo-operated AI SaaS by the maker, not by a law firm. They are reasonable defaults and should be reviewed by an attorney before any high-revenue inflection (acquisition, funding, enterprise contracts, payment-card storage). Last refreshed February 24, 2026.

1. Acceptance & service description

By creating an account or using Soliloquy at trysoliloquy.com or any associated domain (“the Service”) you agree to these Terms of Service. If you do not agree, do not use the Service. The Service is operated as a sole-proprietor business based in California, USA (“we,” “us,” “Soliloquy”).

Soliloquy is an artificial-intelligence conversational tool designed strictly for entertainment, companionship, novelty, voice-acting practice, and tabletop-roleplay rehearsal. It is not a therapist, counselor, doctor, attorney, financial advisor, or any other licensed professional. Nothing the Service generates constitutes medical, psychological, legal, financial, or any other professional advice.

2. Who can use Soliloquy

  • You must be at least 13 years old to use the Service at all.
  • You must be at least 18 years old to enable Adult Mode (NSFW), to view the NSFW marketplace, or to purchase a Pro / Studio plan. Toggling Adult Mode or confirming the marketplace age-gate is an affirmative representation that you are 18+.
  • If you are between 13 and 17, you may use the Service only with the verifiable permission and direct supervision of a parent or legal guardian, and only with Adult Mode off.
  • You may not use the Service if you are barred from receiving it under US export laws or on any sanctioned-party list.

3. Your account & security

You are responsible for the activity that happens under your account, for keeping your password secret, and for letting us know immediately if you suspect compromise. We may suspend or terminate accounts for violating these Terms, for non-payment, or to protect the Service from abuse. Mr. Royce, our automated moderation layer, may temporarily block individual turns and log policy flags; three hard-policy flags trigger an automatic account suspension pending review.

4. Subscriptions, trials, refunds & rewards

  • Free tier: limited monthly voice turns and personas, no Adult Mode, no premium voices.
  • Pro & Studio tiers: paid recurring subscriptions billed via Stripe. Each new subscriber receives a 7-day free trial with payment method on file. You will not be charged until the trial ends; cancel any time during the trial via the customer portal to avoid all charges.
  • Top-ups: one-time additions of voice turns. Standard top-ups (OpenAI voices) are available to all paid tiers at list price. Studio subscribers additionally unlock premium ElevenLabs-grade top-ups priced for the higher voice-model unit cost.
  • Referrals: a referred friend may receive a one-time 15% discount on their first paid month plus +30 bonus voice turns. The referrer also receives +30 bonus voice turns. Bonus turns are non-transferable and non-refundable.
  • Daily-login rewards: voice-turn bonuses or discount codes earned by consecutive logins are non-cash, non-transferable, expire if unredeemed, and may be modified or terminated by us at any time without notice.
  • Refunds: charges are non-refundable except where required by law. You may cancel at any time; cancellation stops future renewals but does not refund the current period.
  • All amounts are in US Dollars. Taxes, if any, are added at checkout.

5. Acceptable use

You agree not to use Soliloquy to:

  • Generate or disseminate child sexual abuse material (CSAM), or any sexual content involving any person depicted, described, or implied to be under 18. Zero tolerance. Violations are reported to the National Center for Missing & Exploited Children (NCMEC) and the appropriate authorities.
  • Impersonate any real, identifiable person without their explicit consent — including but not limited to politicians, celebrities, or private individuals — in a manner that could mislead a reasonable observer. Voice cloning of a real, identifiable human voice is prohibited without that human’s documented written consent on file.
  • Generate content that is unlawful where you live or where you access the Service, including credible threats of violence, terrorism, harassment campaigns, stalking, or operational instructions for weapons of mass casualty.
  • Produce material designed to commit fraud, social engineering, identity theft, deepfake non-consensual intimate imagery, or to bypass security on systems you do not own.
  • Provide professional advice (medical, legal, financial, mental-health crisis, etc.) to third parties under the guise of Soliloquy output. The Service is not a licensed professional and its responses are not advice.
  • Reverse-engineer, scrape, or attempt to derive model weights, training data, or proprietary prompts. Automated traffic is permitted only via documented APIs and within published rate limits.
  • Resell, sub-license, or re-host access to Soliloquy without a separate written agreement.
  • Copy, replicate, or build a competing service using the unique design, branding, original UI code, or marketing language of Soliloquy.

We may remove content, suspend accounts, and refund or forfeit balances at our reasonable discretion to enforce these rules.

6. Your content & license to operate

You retain ownership of the personas you create and the inputs you provide. By using the Service you grant us a worldwide, royalty-free, non-exclusive license to host, process, transmit, transcode, and display that content solely to operate the Service, deliver responses, run abuse review, generate Reels exports you request, and improve product quality in aggregate. We do not sell your content, and we do not use your conversations to train any public AI model.

If you share a persona to the community marketplace, you additionally grant other operators a non-exclusive, royalty-free license to clone and remix it within the Service. You may revoke that public license at any time by un-sharing the persona.

7. AI-generated output — what it is and what it isn’t

Soliloquy is built on third-party large language models and synthetic-voice engines. The replies you receive are statistical predictions, not facts, opinions, or advice. They may be wrong, biased, offensive, or completely fabricated. You are responsible for evaluating and verifying everything the Service produces before relying on it. 8. Mental-health & crisis safety

Soliloquy personas are not crisis counselors, therapists, or mental-health professionals. If you are experiencing a mental-health crisis, severe loneliness, suicidal ideation, or thoughts of self-harm, please seek immediate help from a qualified human professional or a certified crisis hotline:

  • US: dial or text 988 — Suicide & Crisis Lifeline.
  • UK / Ireland: Samaritans 116 123.
  • EU: 112 — emergency.
  • Mr. Royce, our moderation layer, surfaces these resources automatically when a turn signals self-harm ideation.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED OUTPUT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or available at any given time. We do not warrant that AI output will be safe, accurate, helpful, or fit for any particular use. Beta features, experimental personas, and any feature marked “preview” or “soon” are provided without any warranty whatsoever and may be modified or removed at any time.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SOLILOQUY, ITS OPERATOR, OR ITS SUB-PROCESSORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, REPUTATIONAL HARM, EMOTIONAL DISTRESS, OR HARM ARISING FROM AI OUTPUT — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD IS LIMITED TO THE GREATER OF (a) THE AMOUNT YOU PAID TO SOLILOQUY IN THAT PERIOD, OR (b) USD $50.

11. Indemnification

You agree to defend, indemnify, and hold harmless Soliloquy and its operator from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any content you submitted or generated through the Service.

12. Intellectual property

The unique design, branding, original code, marketing copy, and persona archetypes bundled with Soliloquy are owned by the operator and protected by copyright, trademark, and trade-dress laws. You agree not to copy, scrape, replicate, or reverse-engineer the core infrastructure, branding, or original prompts of this website without explicit written permission.

DMCA / copyright complaints. If you believe content available through the Service infringes a copyright you own, email support@trysoliloquy.com with: (i) your contact info; (ii) a description of the copyrighted work; (iii) the URL or location of the allegedly-infringing material; (iv) a statement of good-faith belief that the use is not authorized; (v) a statement under penalty of perjury that your notice is accurate and that you are the owner or are authorized to act; (vi) your physical or electronic signature. We will respond to valid notices in accordance with 17 U.S.C. § 512.

13. Termination & account deletion

You may stop using the Service and close your account at any time via Settings → Privacy & Data → “Delete my account” or by emailing support@trysoliloquy.com. Account deletion removes your personas and conversations within 30 days, except for records we are legally required to keep (Stripe transaction records, abuse-review evidence, sanctioned flag logs). We may suspend or terminate your account if you violate these Terms, if continued operation creates legal risk, or if the Service is discontinued. Inactive accounts (no login for 24 months) may be hibernated and eventually deleted; we will email you twice before this happens. Sections that by their nature should survive termination (e.g., disclaimers, limitations of liability, indemnification, dispute resolution, intellectual property) survive.

14. Force majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, pandemics, war, terrorism, civil unrest, labor disputes, government action, internet outages, third-party model-provider outages, or sub-processor failures.

15. Dispute resolution & governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction and venue there.

Mandatory pre-dispute notice. Before filing any formal dispute, you agree to first email support@trysoliloquy.com with a description of the issue and to give us 30 days to attempt a good-faith resolution.

Class-action waiver. To the extent permitted by law, you and Soliloquy agree that any dispute will be brought on an individual basis only and not as part of a class, collective, or representative action. You waive any right to a jury trial.

16. Severability & assignment

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. You may not assign these Terms without our prior written consent; we may assign them in connection with a sale, merger, or restructuring of the Service.

17. Entire agreement & changes

These Terms together with the Privacy Policy, Cookie Policy, and AI Disclaimerconstitute the entire agreement between you and Soliloquy and supersede any prior agreement on the same subject. We may modify these Terms from time to time. Material changes will be highlighted in the cockpit and the “Effective” date will be updated. Continued use after the effective date constitutes acceptance.
